1. Acceptance and scope
These Terms of Use govern access to and use of the FinEng website. By using the website, the visitor agrees to these terms. A person who does not agree should discontinue use.
These terms apply only to the public website. A client engagement is governed by a separate written agreement, including scope, fees, reliance, confidentiality, liability and governing law provisions.
2. Informational purpose
The website describes general capabilities, methodologies, research themes and mandate archetypes. It does not provide a recommendation concerning any transaction, security, financial product, jurisdiction, legal structure or course of action.
Content may be incomplete, simplified, illustrative, dated or unsuitable for a visitor’s circumstances. Material facts, law, regulation and market conditions can change after publication.
3. No adviser-client relationship
Accessing the website, contacting FinEng, submitting an enquiry or receiving an acknowledgement does not create an adviser-client, fiduciary, confidential, agency or other professional relationship. Such a relationship arises only under a written engagement accepted by Bramston & Associates Ltd.
4. Permitted use
The visitor may view, print and retain reasonable extracts for internal, non-commercial evaluation, provided that the material is not altered, misrepresented or stripped of notices.
The visitor must not:
- use the website unlawfully, fraudulently or to infringe third-party rights;
- attempt unauthorised access, introduce malware, interfere with availability or bypass security controls;
- scrape, harvest or systematically reproduce the website except as permitted by law or written consent;
- represent website content as personalised advice or as an endorsement;
- use names, marks, diagrams or content in a misleading or unrelated commercial product.
5. Intellectual property and attribution
All rights not expressly granted are reserved. No licence to any trade mark, service mark, methodology, database, software or other intellectual property is granted by implication.
6. Third-party links and services
Links to third-party websites are provided for convenience or source attribution. FinEng does not control their availability, security, content, privacy practices or legal terms and does not endorse them merely by linking.
7. Availability and security
The website may be modified, suspended or withdrawn without notice. Although reasonable security measures are intended, no internet service can be guaranteed to be uninterrupted, error-free or free from harmful code.
8. Limitations
To the maximum extent permitted by applicable law, Bramston & Associates Ltd excludes liability arising solely from reliance on public website content, inability to access the site, third-party sites, or unauthorised alteration of transmitted information.
Nothing in these terms excludes liability that cannot lawfully be excluded.
9. Privacy and communications
Personal information submitted through the website is handled in accordance with the Privacy Policy. The public contact form should not be used for passwords, bank details, identity documents, privileged material or other highly sensitive information.
10. Changes, severability and waiver
These terms may be updated by publishing a revised version with a new effective date. If a provision is held invalid or unenforceable, the remaining provisions continue to apply. Failure to enforce a provision is not a waiver.
11. Governing law and jurisdiction
These website terms are governed by the laws of Mauritius. Subject to mandatory law, the courts of Mauritius have jurisdiction over disputes concerning use of this website. Engagement agreements may contain different provisions.
